These Terms of Service ("Terms") govern your access to and use of HeyWoozy, an AI receptionist platform operated by Creative Crew Studio ("we", "us", "our"), accessible at heywoozy.com. By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use HeyWoozy.
1. Service Description
HeyWoozy is a software-as-a-service (SaaS) platform that provides AI-powered receptionist capabilities for businesses. The service includes automated responses to customer messages across WhatsApp, Facebook Messenger, Instagram Direct Messages, and phone calls. HeyWoozy handles lead capture, appointment booking, conversation management, and human escalation on behalf of your business.
HeyWoozy uses artificial intelligence to generate responses based on the business information and knowledge base you provide. While we strive for accuracy, AI-generated responses may occasionally contain errors. You are responsible for reviewing and managing the interactions your AI receptionist has with your customers.
2. Account Terms
- You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business.
- You must provide accurate and complete registration information. You are responsible for keeping your account credentials secure.
- You are responsible for all activity that occurs under your account, including actions taken by team members you invite.
- You must promptly notify us if you become aware of any unauthorised access to your account.
- One person or business may not maintain more than one free trial account.
3. Acceptable Use
You agree not to use HeyWoozy to:
- Send spam, unsolicited messages, or bulk messaging that violates applicable law or platform policies
- Harass, threaten, or abuse any person
- Distribute illegal, harmful, or offensive content
- Impersonate another person or entity
- Violate any applicable law, regulation, or third-party rights
- Circumvent WhatsApp, Facebook, or Instagram platform policies, including Meta's Business Messaging and Commerce Policies
- Attempt to reverse-engineer, disassemble, or extract source code from our platform
- Interfere with or disrupt the integrity or performance of the service
- Use the service to collect data about individuals without a lawful basis
We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use terms.
4. Payment Terms
- HeyWoozy is offered on a subscription basis with monthly or annual billing cycles. Current pricing and plan details are available on our pricing page.
- Free trials are available on select plans. No credit card is required to start a trial. At the end of your trial period, you must subscribe to a paid plan to continue using the service.
- All payments are processed securely through Stripe. By subscribing, you authorise us to charge your chosen payment method on a recurring basis.
- Prices are quoted in US Dollars and are exclusive of applicable taxes unless stated otherwise.
- We may change our pricing with 30 days' notice. Price changes will apply from the start of your next billing cycle after the notice period.
- You may upgrade, downgrade, or cancel your plan at any time through your account dashboard. Downgrades and cancellations take effect at the end of your current billing period.
- Refunds are handled on a case-by-case basis. Contact us at hello@woozysocial.com for refund requests.
5. Intellectual Property
The HeyWoozy platform, including its design, code, branding, documentation, and AI models integration, is the intellectual property of Creative Crew Studio. You may not copy, modify, distribute, or create derivative works based on our platform.
You retain full ownership of all content you provide to HeyWoozy, including your business information, knowledge base content, and conversation data. By using the service, you grant us a limited licence to use this content solely to operate and provide the service to you.
We do not claim ownership of the conversations between your AI receptionist and your end users. That data belongs to you and is subject to our Privacy Policy.
6. Data Processing
When you use HeyWoozy, we process messages received from your customers on your behalf. In this capacity, you are the data controller and we are the data processor as defined under UK GDPR.
You are responsible for ensuring that your use of HeyWoozy complies with applicable data protection laws, including providing appropriate privacy notices to your end users and having a lawful basis for processing their data.
We process message content through third-party AI services (Google Gemini) to generate responses. Message content sent to AI services is used solely for generating responses and is not used to train third-party models. For full details on how we handle data, refer to our Privacy Policy.
7. Service Availability
We aim to provide 99.9% uptime for the HeyWoozy platform. However, we do not guarantee uninterrupted access. The service may be temporarily unavailable due to scheduled maintenance (which we will announce in advance where possible), third-party service outages (including Meta, Twilio, or cloud providers), or circumstances beyond our reasonable control.
8. Limitation of Liability
To the maximum extent permitted by law, Creative Crew Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of business, loss of data, or loss of goodwill, arising out of or in connection with your use of HeyWoozy.
Our total aggregate liability for any claims arising from or related to these Terms or the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
We are not liable for any errors, inaccuracies, or inappropriate responses generated by the AI. You acknowledge that AI-generated content may occasionally be incorrect, and you accept responsibility for monitoring and managing your AI receptionist's interactions.
9. Indemnification
You agree to indemnify and hold harmless Creative Crew Studio, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of HeyWoozy, your violation of these Terms, or your violation of any rights of a third party.
10. Termination
You may cancel your account at any time through your dashboard or by contacting us. Cancellation takes effect at the end of your current billing period.
We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if required to do so by law. We may also terminate your account with 30 days' notice for any reason.
Upon termination, your right to use the service ceases immediately. Your data will be retained for 30 days after termination to allow for reactivation or export, after which it will be permanently deleted within 90 days. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, limitation of liability, indemnification, and governing law.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by email or through a notice on the platform. Continued use of HeyWoozy after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the service and cancel your account.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
